R1 and R3 with one out.  Batter skies a fly ball.  R3 takes off for home.  R1 tags up.  BR running with his head down, passes R1 before the catch.  CF catches the ball and fires to third.  Is R3 out on the appeal?

The batter was not out on the fly ball since he was out for passing the runner at first.  I'm wondering if the appeal play is still on.

I say yes, the out is not what the runner is waiting on, it's the catch.

The runner is allowed to leave as soon as the ball is touched, it does not mean there is going to be an out in this situaton either.

The same rule applies here in my opinion, as soon as the balll is touched the runner can tag u and go, whatever happens to the batter runner is irrelevant in the eyes of the runner at third.

That's not totally true.  If R3 leaves early and the ball is dropped, he doesn't have to return to tag up.  If the ball is popped to first and the BR doesn't run while R3 is streaking home and the ball is dropped and the BR is put out on a play at first, the runner doesn't have to tag, why should he be out on the appeal if the out is recorded without need of the catch?

Because the rule is a runner has to tag up at his base when the ball is touched, if the ball is caught, not if the runner is out on the catch.

I see the fly ball and the batter/runner running as two related but separate events.  The B/R has the right to start running, based on him hitting the ball.  The fact he was called out for something totally unrelated to the fly ball wouldn't have any indication on the runner on 3B still having to retouch.

Out on appeal I would say!  Argument either way, but I could win this one!!

"Coach, if you runner hadn't of been such a moron, we wouldn't be in this predicament, would we?? and walk away rolling you eyes!!  hehe
